Information first
On reasonable request, a qualified beneficiary receives a report of information relevant to that beneficiary's interest, including the trust provisions that describe or affect it (O.C.G.A. § 53-12-243(a)), and the accounting goes at least annually to the beneficiaries to whom income or principal may be distributed (§ 53-12-243(b)). Many disagreements are about what has not been seen; the record answers them. Where a disagreement is about an instrument's meaning, the court may hear parol evidence of the circumstances surrounding the settlor to explain ambiguities (§ 53-12-27).
The nonjudicial settlement agreement
The trustee, any trust director and all other persons whose interests would be affected may enter into a binding nonjudicial settlement agreement on any matter involving the trust, valid only to the extent it does not violate a material purpose of the trust and includes terms the court could properly approve — and not, during the settlor's lifetime, a modification or termination of an irrevocable trust the court could approve only under § 53-12-61(b) (O.C.G.A. § 53-12-9). Any of them may ask the court to approve the agreement or to determine whether the representation under § 53-12-8 was adequate. A person who may represent and bind another — a conservator, a guardian, an agent, a person the instrument designates, an ancestor for a minor or unborn descendant — may consent for them, absent a conflict (§ 53-12-8).
The court
Actions concerning the construction or administration of a trust go to the superior court, or to the probate court in a county whose probate court is an Article 6 court (O.C.G.A. § 53-12-6; § 15-9-127). A trustee may petition for approval of an interim accounting relieving the trustee from liability for the period (§ 53-12-230); a directed trustee or a trust director may petition for instructions (§ 53-12-504, § 53-12-503); the court may modify or terminate a trust on the grounds § 53-12-61 states, reform it for a mistake (§ 53-12-60), or remove a trustee for a serious breach, lack of cooperation among cotrustees, unfitness or persistent failure, a substantial change of circumstances, or at all the qualified beneficiaries' request on the statute's findings (§ 53-12-221).
What a breach of trust means
A violation by the trustee of any duty owed to the beneficiary is a breach of trust (O.C.G.A. § 53-12-300). A beneficiary may seek damages, compel the trustee to perform, require an accounting, enjoin a breach, compel redress, obtain a temporary trustee or a suspension, remove the trustee, and reduce or deny compensation (§ 53-12-301); the trustee is chargeable with the loss, any profit and what would have accrued, with interest, and in the court's discretion the expenses of litigation (§ 53-12-302). No provision in the instrument relieves a trustee of liability for bad faith or reckless indifference (§ 53-12-303). A claim is barred two years after a written report that adequately disclosed it was sent, and otherwise six years after discovery (§ 53-12-307).

Kesyon moun poze souvan
Can Georgia beneficiaries and the trustee settle a dispute without court?
Yes — a binding nonjudicial settlement agreement among the trustee, any trust director and all persons whose interests would be affected, valid to the extent it does not violate a material purpose and contains terms the court could approve (O.C.G.A. § 53-12-9); the court may be asked to approve it.
Can beneficiaries remove a Georgia trustee?
The court may remove a trustee at the request of all the qualified beneficiaries where removal best serves the beneficiaries, is not inconsistent with a material purpose and a suitable successor is available, and on the other grounds O.C.G.A. § 53-12-221 states; the instrument may provide its own method.
What court hears a Georgia trust dispute?
The superior court, except that the probate court of a county whose probate court is an Article 6 court has concurrent jurisdiction over actions concerning trusts, trustees and trust directors (O.C.G.A. § 53-12-6; § 15-9-127).
