Settling by agreement

MCL 700.7111 provides that interested persons may enter into a binding nonjudicial settlement agreement on any matter involving a trust — among them interpreting the terms, approving a trustee's report, directing a trustee, appointing or accepting the resignation of a trustee and setting compensation — valid only to the extent it does not violate a material purpose and contains terms a court could approve. It may not be used to terminate or modify the trust. Any interested person or trustee may ask the court to approve or disapprove it.

The probate court

A trust is administered free of the court unless an interested person invokes its jurisdiction (MCL 700.7201), and the probate court has exclusive jurisdiction of proceedings concerning a trust's internal affairs (MCL 700.1302). The settlor, a cotrustee or a qualified trust beneficiary may ask the court to remove a trustee — for example, for a serious breach of trust, cotrustees' lack of cooperation, or persistent failure to administer effectively (MCL 700.7706).

Remedies and the time limits

To remedy a breach of trust the court may, among other things, compel performance, order an account, suspend or remove the trustee, or reduce or deny compensation (MCL 700.7901). A beneficiary's proceeding for breach of trust is limited to 1 year after a report that adequately disclosed the potential claim and stated the time allowed, and otherwise to the periods of MCL 700.7905. In a proceeding involving a trust's administration, the court may award costs and expenses, including reasonable attorney fees, to any party who enhances, preserves or protects trust property, as justice and equity require (MCL 700.7904).
