How a trust terminates

A trust terminates to the extent it is revoked or expires under its terms, no purpose of the trust remains to be achieved, or its purposes have become unlawful, contrary to public policy or impossible (Tenn. Code Ann. § 35-15-410(a)). A trust may also be modified or terminated by consent — during the settlor's life by the trustee with all qualified beneficiaries' consent on 60 days' notice to the settlor, after the death by the trustee and the qualified beneficiaries, or by the court (Tenn. Code Ann. § 35-15-411); for unanticipated circumstances (Tenn. Code Ann. § 35-15-412); or, after notice to the qualified beneficiaries, as an uneconomic trust whose property is less than $250,000 or whose scheduled fee reaches the statute's percentage (Tenn. Code Ann. § 35-15-414(a)).

The distribution and the reserve

On an event terminating or partially terminating the trust, or on a trustee's removal or resignation, the trustee proceeds within a reasonable time to distribute the trust property to the persons entitled to it, subject to the right to retain a reasonable reserve for the payment of debts, expenses, attorney fees and taxes (Tenn. Code Ann. § 35-15-817(a)). The two-year contest window (Tenn. Code Ann. § 35-15-604) and the twelve-month bar on claims against the settlor (Tenn. Code Ann. § 30-2-310) are the dates a trustee and a licensed Tennessee attorney of your choosing weigh before the final distribution.

The discharge notice, and the year after

The trustee may give the notice of Tenn. Code Ann. § 35-15-817(c) — to the living grantor, each qualified beneficiary or conflict-free representative, every other serving trustee, trust advisor and trust protector — with a statement of the trust's assets and liabilities at fair market value dated within 30 days, the receipts and disbursements with their sources and payees for a period of at most three years, the remaining fees and the statutory warning that claims are barred absent a specific written objection within 45 days after receipt; receipt is presumed five business days after mailing ((k)), and a compliant notice with no timely objection has the preclusive effect Tenn. Code Ann. § 35-15-1005(e) states. Apart from it, a beneficiary's claim is brought within one year after adequate disclosure or actual knowledge, or three years after the trustee's departure or the trust's termination (Tenn. Code Ann. § 35-15-1005). On petition the court may order a final accounting (Tenn. Code Ann. § 35-15-205).
