The requests, and the copy of the instrument
Est. & Trusts § 14.5-813(a) provides that, unless unreasonable under the circumstances, a trustee promptly responds to a qualified beneficiary's request for information related to the administration of the trust, including a copy of the trust instrument. The trust's terms cannot remove that duty (Est. & Trusts § 14.5-105(10)).
The two notices, and how they are delivered
Within 60 days after accepting a trusteeship, the trustee notifies the qualified beneficiaries of the acceptance and of the trustee's name, address and telephone number; within 90 days after acquiring knowledge that a formerly revocable trust has become irrevocable, the trustee notifies them of the trust's existence, the identity of the settlor, the right to request a copy of the instrument and the right to a trustee's report (Est. & Trusts § 14.5-813(b)(1)). Neither applies to a trustee that accepted, or a trust that was or became irrevocable, before January 1, 2015 (§ 14.5-813(e)).
Delivery is part of the duty. A notice goes to each known qualified beneficiary personally or by a method Est. & Trusts § 14.5-109(a)(3)(ii) names — personal service; certified or first-class mail, return receipt requested; or courier with delivery confirmation — and by first-class mail, fax with a confirmation page or e-mail with acknowledgment requested only where the recipient agreed in writing to that method. A beneficiary whose name or address is not known is notified by publication once a week for three successive weeks in the county where the trust property is located (Est. & Trusts § 14.5-813(b)(2)). A trustee who knows or should know that an alternative-method notice was not received sends it again by one of the statute's first three methods (§ 14.5-109(a)(3)(iv)).
The report on request, and what a report can start
Est. & Trusts § 14.5-813(c)(1) provides that, on request by a qualified beneficiary, the trustee sends that beneficiary annually and at the termination of the trust a report of the trust property, liabilities, receipts and disbursements, including the source and amount of the trustee's compensation, a listing of the trust assets and, if feasible, their respective market values. Maryland sets no report without a request.
A report matters beyond the information it carries. Under Est. & Trusts § 14.5-904(a), a beneficiary may not bring a judicial action against a trustee for breach of trust more than one year after the beneficiary or a representative is sent a report that adequately discloses the existence of a potential claim and informs of the time allowed for bringing an action. Whether a particular report does so is a question of its contents — the kind a licensed Maryland attorney of your choosing answers.
The waivers and the terms
A qualified beneficiary may waive the right to a report or other information, and may withdraw the waiver as to future reports; a trustee who is a qualified beneficiary owes no report to themself (Est. & Trusts § 14.5-813(d)). The terms cannot remove the duties to answer requests and to report on request (Est. & Trusts § 14.5-105(10)), nor the duty to notify a qualified beneficiary of an irrevocable trust who has attained 25 years of age (§ 14.5-105(11)).
