The two commissions
SCPA 2309(1) provides that on the settlement of a trustee's account the court allows the trustee's reasonable and necessary expenses and a commission of 1% for paying out all sums constituting principal. SCPA 2309(2) adds annual commissions: $10.50 per $1,000 on the first $400,000 of principal, $4.50 on the next $600,000, and $3.00 on all additional principal, computed on the principal's value at the end of the period — or, at the trustee's binding first election, at its beginning.
Unless the instrument explicitly provides otherwise, the annual commissions are payable one-third from income and two-thirds from principal (SCPA 2309(3)), and commissions payable from income for a trust year may be retained only from that year's income (SCPA 2309(4)).
The annual statements
SCPA 2309(4) provides that the annual commissions may be retained by a trustee who furnishes annually a statement of the principal assets on hand and a statement of all receipts of income and principal, including the commissions retained and the basis on which they were computed — to each beneficiary currently receiving income and to others interested who demand them.
A trustee does not waive commissions by failing to retain them when they become due, and on the settlement of the account any person interested may dispute the amount of any commission claimed or retained (SCPA 2309(2), (4)).
Other allowances, and what the instrument can say
A trustee who is a New York attorney and renders legal services in connection with the trust may be allowed just and reasonable compensation for those services in addition (SCPA 2309(1)), and a trustee who collects rents and manages real property may retain 6% of the gross rents, one such commission regardless of the number of trustees (SCPA 2309(7)).
The instrument matters too: where a will provides a specific compensation for a trustee, the trustee is not entitled to any other allowance for services (SCPA 2309(10)). Family trustees commonly waive commissions — a choice, not a requirement.
More than one trustee
SCPA 2309(6) sets how many commissions for paying out principal are allowed when there is more than one trustee, by the size of the trust: below $100,000, one commission is apportioned among them; from $100,000 to $400,000, each of up to two trustees takes a full commission; at $400,000 or more, each of up to three — subject to SCPA 2313 for instruments after August 31, 1993, and with apportionment by the services rendered where there are more trustees.
