When a trust ends

20 Pa.C.S. §7740 provides that a trust terminates to the extent it is revoked or expires under its terms, no purpose remains to be achieved, or its purposes have become unlawful or contrary to public policy; it may also be modified or terminated by consent or by the court as the following sections provide (§§7740.1, 7740.2).

Distribution and the reserve

On an event terminating or partially terminating a trust, the trustee distributes the trust property within a reasonable time to the persons entitled to it, subject to the right to keep a reasonable reserve for the payment of debts, expenses and taxes (20 Pa.C.S. §7780.7).

Closing the books

A trustee may settle its account without the court by sending the persons the statute lists a notice with the reason, the proposed distribution, estimated expenses and account statements for 30 months or the trust's shorter term; a recipient may object in writing within 60 days after the notice was sent (20 Pa.C.S. §7785.1). A trustee may instead file an account with the clerk of the orphans' court division, and files one whenever the court directs (§7797).

Claims by a beneficiary against a trustee are generally barred five years after the first of the trust's termination, the end of the beneficiary's interest, or the notice of a change of trustee after a removal, resignation or death (20 Pa.C.S. §7785(b)).
