After an Illinois settlor's death, the successor trustee takes reasonable steps to take control of and protect the trust property (760 ILCS 3/809) and, within 90 days of the trust becoming irrevocable, notifies each qualified beneficiary of the trust's existence and the beneficiary's rights (760 ILCS 3/813.1(b)(1)). The settlor's creditors are barred two years after the death (755 ILCS 5/18-12).

The first week: decide, secure, and find the documents
A trust the settlor could revoke becomes irrevocable at the settlor's death. While it was revocable and the settlor had capacity to revoke it, the trustee's duties were owed exclusively to the settlor (760 ILCS 3/603(a)). A person designated as successor trustee accepts by the method the trust instrument provides or — where it provides none, or its method is not expressly exclusive — by accepting delivery of the trust property, exercising powers or performing duties as trustee, or otherwise indicating acceptance; one who does not accept within 120 days after receiving notice of the designation is deemed to have declined (760 ILCS 3/701).
Before deciding, a designated trustee may act to preserve the trust property, sending a declination within the 120 days if declining, and may inspect or investigate it (760 ILCS 3/701(c)). Find the trust instrument and every amendment, the death certificate, recent statements, deeds, titles and beneficiary designations. Whoever holds the settlor's will files it with the clerk of the circuit court immediately upon the death (755 ILCS 5/6-1).
The notices: 90 days, each from its own beginning
Within 90 days of the trust becoming irrevocable — or, if no trustee was then acting, of the trustee's acceptance — the trustee notifies each qualified beneficiary of the trust's existence, of the beneficiary's right to request a complete copy of the trust instrument (or, where the instrument so provides, only the portions that set forth the terms in which the beneficiary has an interest), and of whether the beneficiary has a right to receive or request trust accountings (760 ILCS 3/813.1(b)(1)). A trustee who accepts the trusteeship also notifies them, within 90 days after the acceptance, of the acceptance and of the trustee's name, address and telephone number (760 ILCS 3/813.1(d)(1)(A)). Two notices, each with its own clock; they are often sent together.
A qualified beneficiary is each current beneficiary and each presumptive remainder beneficiary (760 ILCS 3/103). Notice may be sent by first-class mail, personal delivery, delivery to the last known residence or place of business, or a properly directed electronic message (760 ILCS 3/109); receipt of an electronic notice is presumed only where the beneficiary agreed to it (760 ILCS 3/813.1(h)). A trust that became irrevocable, with a trustee already acting, before January 1, 2020 follows 760 ILCS 3/813.2 instead.

Taking control and listing the assets
The trustee takes reasonable steps to take control of and protect the trust property, including searching for and, if practicable, claiming any unclaimed property (760 ILCS 3/809), keeps adequate records and keeps the trust's property separate from the trustee's own (760 ILCS 3/810), and within a reasonable time reviews the assets under the Illinois Prudent Investor Law (760 ILCS 3/904). A successor trustee has the predecessor's rights, powers and duties and is under no duty to inquire into the predecessor's acts (760 ILCS 3/812).
Illinois issues no letters of trusteeship for a living trust; the trust is administered without continuing court supervision unless the court orders it (760 ILCS 3/201). Banks, brokers and title companies usually accept a certification of trust instead of the whole instrument (760 ILCS 3/1013).
Creditors, the estate, and the two-year bar
The property of a trust that was revocable at the settlor's death is subject to the settlor's creditors' claims, the costs of administering the estate, the funeral expenses and the spouse's and children's awards to the extent the probate estate is inadequate; a claim barred against the personal representative is barred against the trust, and the Probate Act's classification and priority of claims apply once a right to collect from the trust is perfected (760 ILCS 3/505(a)(5)).
Where an estate is opened, its representative publishes a notice to creditors and mails or delivers it to each known or reasonably ascertainable creditor, with a claims date not less than 6 months from the first publication or 3 months from the mailing (755 ILCS 5/18-3). Whether or not letters are issued, every claim against the estate except administration expenses and the family's awards is barred 2 years after the death (755 ILCS 5/18-12). The Illinois Trust Code gives the trustee of a living trust no creditor notice to publish. A trustee who distributes nine months or later after the death, in accordance with the instrument and without a personal representative's written notice that the estate is or may be insufficient, is released from the trust's liability for the assets distributed (760 ILCS 3/505(a)(6)).
The surviving spouse and the family
The surviving spouse's award — a reasonable sum for 9 months' support, not less than $20,000 plus not less than $10,000 for each minor or dependent child residing with the spouse — is exempt from creditors' process and paid from the estate (755 ILCS 5/15-1); a child's award follows where there is no spouse or a child did not reside with the spouse (755 ILCS 5/15-2). Trust property answers for the awards only where the probate estate is inadequate (760 ILCS 3/505(a)(5)). A surviving spouse of a decedent who left a will may renounce the will within 7 months after its admission and take one-third of the estate if the testator leaves a descendant, or one-half if none (755 ILCS 5/2-8) — the spouse's own decision.

A home titled to the trust passes under the trust's terms; a deed from the trustee to a beneficiary is the written instrument of conveyance Illinois requires for real property (760 ILCS 3/115). Illinois places no restriction on devising a home. The estate of homestead — $50,000 of value exempt from the collection of a judgment and from the laws of conveyance, descent and legacy — continues after the owner's death for the surviving spouse and minor children (735 ILCS 5/12-901). A home left in the decedent's own name passes by will or intestacy through the estate, or under a recorded transfer on death instrument (755 ILCS 27/20).
Accountings, the contest window and the nine-month rules
At least annually the trustee sends a trust accounting — the trust property, liabilities, receipts and disbursements including the trustee's compensation, the closing values to the extent feasible and the other material facts (760 ILCS 3/103) — to all current beneficiaries and all presumptive remainder beneficiaries (760 ILCS 3/813.1(b)(2), (3)). A matter the accounting adequately discloses binds unless an action is brought within 2 years after it is furnished (760 ILCS 3/1005(a)(1)).
A trust that was revocable at the death may be contested within the earlier of 2 years after the death and either the time to contest the settlor's probated will or 6 months after the trustee sends the person a copy of the instrument with the notice the statute describes (760 ILCS 3/604(a)); nine months after the death the trustee may distribute under the instrument without liability unless a contest is pending or a potential contestant's notice is followed by a proceeding within 60 days (760 ILCS 3/604(b)). Where the gross estate plus adjusted taxable gifts exceeds $4,000,000, an Illinois estate tax return is due with the federal return (35 ILCS 405/2, 35 ILCS 405/6).
When a licensed Illinois attorney is the right next call
TrusteeClear explains and organizes; it does not decide who is a qualified beneficiary, which accounting regime a trust falls under, whether a claim is barred, or whether a distribution is protected. Many trustees bring the trust, the estate's claims position and the real-property questions to a licensed Illinois attorney of their choosing.

How long does an Illinois successor trustee have to notify beneficiaries?
90 days: of the trust becoming irrevocable, notice of its existence and the beneficiary's rights (760 ILCS 3/813.1(b)(1)); after accepting the trusteeship, notice of the acceptance (760 ILCS 3/813.1(d)(1)(A)). Each runs from its own beginning.
Does an Illinois trustee publish a notice to creditors?
No — the Illinois Trust Code gives the trustee of a living trust no creditor notice to publish. The estate's representative publishes and mails the notice (755 ILCS 5/18-3); whether or not an estate is opened, claims are barred 2 years after the death (755 ILCS 5/18-12), and the trust's property answers after the estate's (760 ILCS 3/505(a)(5)).
Does an Illinois successor trustee get letters from the court?
No. A living trust is administered without continuing court supervision unless the court orders it (760 ILCS 3/201), and third parties usually accept a certification of trust (760 ILCS 3/1013).
How long can someone contest an Illinois revocable trust after the death?
Within the earlier of 2 years after the settlor's death and either the time to contest the settlor's probated will or 6 months after the trustee sends the notice 760 ILCS 3/604(a) describes.
What does "nine months" mean for an Illinois trustee?
Two things: nine months after the death the trustee may distribute under the instrument without liability unless a contest is pending or threatened (760 ILCS 3/604(b)), and a trustee who distributes nine months or later, without a personal representative's written insufficiency notice, is released from the trust's liability for the settlor's creditors as to what was distributed (760 ILCS 3/505(a)(6)).
