The duty to inform and account under Illinois law

Illinois's trust code puts the duty to inform and account in one section, 760 ILCS 3/813.1, for a trust that became irrevocable after January 1, 2020. This guide walks through what it provides, to whom, and when — and the older section that still governs some trusts.

Who is kept informed

The notices and accountings of 760 ILCS 3/813.1 go to the qualified beneficiaries — each current beneficiary, who may receive income or principal on the date in question, and each presumptive remainder beneficiary, who would receive it if the trust or every current interest ended that day (760 ILCS 3/103). While a trust is revocable and the settlor has capacity to revoke it, the duties are owed to the settlor alone (760 ILCS 3/603). A designated representative the instrument nominates may receive the notices for a qualified beneficiary (760 ILCS 3/307).

The notices

Within 90 days of the trust becoming irrevocable — or of the acceptance, if no trustee was then acting — the trustee notifies each qualified beneficiary of the trust's existence, of the right to request a complete copy of the instrument (or only the beneficiary's portions, where the instrument so provides), and of whether the beneficiary has a right to receive or request trust accountings; later knowledge of a new qualified beneficiary or an unnotified representative starts its own 90 days (760 ILCS 3/813.1(b)(1)). Within 90 days after accepting, the trustee notifies them of the acceptance and of the trustee's name, address and telephone number; a change in compensation is noticed in advance, a resignation is noticed, and another trustee's departure and the trustee's own contact changes within 90 days (760 ILCS 3/813.1(d)). Notice is sent in a manner reasonably suitable and likely to result in receipt, including a properly directed electronic message (760 ILCS 3/109).

The trust accounting

At least annually, the trustee sends a trust accounting — the trust property, liabilities, receipts and disbursements, including the trustee's compensation; the closing values to the extent feasible; and the other material facts of the administration (760 ILCS 3/103) — to all current beneficiaries and all presumptive remainder beneficiaries, and on termination to the beneficiaries entitled to the residue (760 ILCS 3/813.1(b)(2)–(4)). On a qualified beneficiary's reasonable request the trustee promptly furnishes a complete copy of the instrument (760 ILCS 3/813.1(b)(6)). A qualified beneficiary may waive the information in writing and later withdraw the waiver (760 ILCS 3/813.1(g)). An accounting or other writing that adequately discloses a matter starts a two-year period for a proceeding about it (760 ILCS 3/1005(a)(1)).

Trusts under the older rules

For a trust that became irrevocable, with a trustee already acting, before January 1, 2020, 760 ILCS 3/813.2 applies instead: a current account at least annually to the beneficiaries entitled to or receiving the income, and a final account on termination to those entitled to distribution; a current or final account under that section binds unless an action is brought within 3 years (760 ILCS 3/1005(a)(2)). Which section governs a particular trust is a question of its own dates, and reading a mixed history is licensed-attorney work.

Частые вопросы

Who is entitled to information about an Illinois trust?

The qualified beneficiaries — each current beneficiary and each presumptive remainder beneficiary (760 ILCS 3/103) — receive the notices and the trust accountings of 760 ILCS 3/813.1; a qualified beneficiary may request a complete copy of the instrument (760 ILCS 3/813.1(b)(6)).

Does an Illinois trustee have to send an annual accounting?

Illinois's statute provides for a trust accounting at least annually to all current beneficiaries and all presumptive remainder beneficiaries, and on termination to the residue's takers (760 ILCS 3/813.1(b)(2)–(4)); a qualified beneficiary may waive it in writing (760 ILCS 3/813.1(g)).

Can an Illinois trust limit what the beneficiaries are told?

Within limits: the instrument may confine a beneficiary's copy to the portions that set forth the beneficiary's interest (760 ILCS 3/813.1(b)(1)), but for a trust that became irrevocable after January 1, 2020 the notice of the trust's existence and the accountings to the current beneficiaries and the residue's takers are mandatory rules the instrument cannot remove (760 ILCS 3/105).
