An Ohio will is signed at the end and attested by two witnesses in the testator's conscious presence (R.C. 2107.03); Ohio has no self-proving affidavit — the court admits the will on its face or on the witnesses' testimony (R.C. 2107.18), or on a lifetime declaration of validity (R.C. 5817.10). The original may be deposited with the probate judge (R.C. 2107.07); a codicil takes the same formality; at death the executor files the inventory within three months (R.C. 2115.02).

The original, and where it lives
Keep the signed original where your executor can find it, and tell the executor where. A will may be deposited by the testator, or by another for the testator, with the judge of the probate court of the county where the testator lives, before or after the death, for a fee of $25; the judge keeps it in a sealed envelope indorsed with the testator's name, and it is not opened until delivered to a person entitled to it, until the testator seeks a lifetime declaration of validity, or until otherwise disposed of, and is not a public record until an application to probate it is filed (R.C. 2107.07). A photocopy is not the will.
How it was signed, and proving it
Except an oral will, every will is in writing, signed at the end by the testator or by another person in the testator's conscious presence and at the testator's express direction, and attested and subscribed in the testator's conscious presence by two or more competent witnesses who saw the testator subscribe or heard the testator acknowledge the signature; "conscious presence" excludes sight or sound sensed by telephone or electronic communication (R.C. 2107.03). Ohio has no self-proving affidavit: the probate court admits the will on its face or, in its discretion, on the witnesses' testimony, if its execution complies with the law in force where and when it was executed, Ohio's law at the death, or the law of the testator's domicile (R.C. 2107.18). During life, the testator alone may ask the probate court to declare the will valid — properly executed, made with capacity and free from undue influence, duress, fraud and mistake — after which it is admitted on request unless revoked (R.C. 5817.02; R.C. 5817.10(A)).
Your executor
The executor you name is appointed by the probate court, which has exclusive jurisdiction to grant letters and to direct and control the executor's conduct (R.C. 2101.24(A)). The executor files an inventory of the Ohio real property and the personal property to be administered within three months of appointment, at date-of-death values (R.C. 2115.02); allows or rejects each creditor's claim within thirty days of presentation (R.C. 2117.06(D)); submits the Medicaid estate recovery notice within thirty days of the letters where it applies (R.C. 2117.061); and renders accounts to the court — a final and distributive account within six months, or an account within thirteen months and yearly thereafter, and a final account within thirty days after completing the administration (R.C. 2109.301). A fiduciary who fails to file an inventory or account on time may be removed and denied compensation (R.C. 2109.24).
What changes a will
A codicil changes a will and takes the same formality — written, signed at the end and attested by two witnesses in the testator's conscious presence (R.C. 2107.03). A will cannot revoke or amend a revocable trust unless the trust's terms expressly allow it (R.C. 5806.02(C)). A child born through assisted reproductive technologies more than three hundred days after the settlor's death is not the settlor's child under a trust unless the terms clearly provide otherwise (R.C. 5801.12). Review the will after a marriage, a divorce, a birth or a death; the surviving spouse's rights are the statute's regardless — the election against the will (R.C. 2106.01), dower (R.C. 2103.02), the $40,000 allowance for support (R.C. 2106.13) and the mansion house (R.C. 2106.10).
A will and a trust together
Many plans pair a will with a revocable trust. The trust governs what is titled to the trustee; the will governs what is not, and often pours what is left into the trust. A transfer on death designation affidavit passes real property to named beneficiaries outside the will (R.C. 5302.22), and a designation naming a trustee passes to the trustee serving at the time (R.C. 5810.14(B)). An estate of $35,000 or less, or $100,000 or less where the surviving spouse takes everything, may be released from administration (R.C. 2113.03); a smaller estate may be summarily released (R.C. 2113.031). Ohio levies no estate tax on a death on or after January 1, 2013 (R.C. 5731.02).
What happens at your death
The will is offered for probate and admitted on its face or on the witnesses' testimony (R.C. 2107.18); a contest is commenced within three months after the filing of the certificate of notice of the admission (R.C. 2107.76). Every creditor presents its claim within six months of the death or is barred (R.C. 2117.06). The surviving spouse elects whether to take under the will or under the statute within five months of the initial appointment (R.C. 2106.01(E)). Property passes under the will, or by intestacy where the will does not reach it (R.C. 2105.06). The executor's Ohio income tax returns for the decedent and the estate are filed as R.C. 5747.08 provides.
When a licensed Ohio attorney is the right next call
Whether the will was properly executed, whether to seek a lifetime declaration of validity, how the will and the trust fit, what the surviving spouse's rights mean for the plan, and whether a codicil or a new will is the better change are questions a licensed Ohio attorney of your choosing answers from your documents. TrusteeClear explains the statute and organizes the record; it decides none of them.
Частые вопросы
Does Ohio have a self-proving affidavit for wills?
No. The probate court admits a will on its face or, in its discretion, on the witnesses' testimony (R.C. 2107.18); a testator may instead obtain a lifetime judgment declaring the will valid (R.C. 5817.02; R.C. 5817.10).
Where should an Ohio will be kept?
Where the executor can find it. It may be deposited with the probate judge of the county where the testator lives for a $25 fee, sealed and not opened until needed, and not a public record until an application to probate it is filed (R.C. 2107.07).
Can my Ohio will change my trust?
Not unless the trust's terms expressly allow revocation or amendment by a will or codicil (R.C. 5806.02(C)); a will's disposition to the trustee adds property to the trust but does not amend it.
What does an Ohio executor do first?
After the court grants letters, files the inventory within three months (R.C. 2115.02), gives the Medicaid notice where it applies (R.C. 2117.061), allows or rejects presented claims within thirty days (R.C. 2117.06(D)) and accounts to the court as R.C. 2109.301 provides.
