Adequate records, separate property

A trustee keeps adequate records of the administration of the trust (Tenn. Code Ann. § 35-15-810(a)), keeps trust property separate from the trustee's own property ((b)), and causes the trust property to be designated so that the trust's interest, to the extent feasible, appears in the records of a third party ((c)); a trustee may invest the property of two or more trusts together where the records clearly indicate each trust's interest ((d)). A trust divided into separate shares is treated as separate trusts for the purposes the section states ((e), (f)).

The ledger, the delivery record and the report

Each receipt and disbursement, with its date, its source or payee and its character as income or principal, is the ledger a report draws on; each notice sent, with its recipient, its method and its date, is the delivery record that shows the statute's method was used — first-class mail or personal delivery for the initial notice (Tenn. Code Ann. § 35-15-813(b)(2)(A)), the general methods for the rest (Tenn. Code Ann. § 35-15-109(a)(2)). No periodic report is required by statute; a report the trustee chooses to send that adequately discloses facts indicating the existence of a potential claim for breach of trust starts the one-year period of Tenn. Code Ann. § 35-15-1005(a) — a document a licensed Tennessee attorney of your choosing prepares when it is meant to do so.

Частые вопросы

What records does a Tennessee trustee have to keep?

Adequate records of the administration, with the trust property kept separate from the trustee's own and designated as the trust's in third-party records (Tenn. Code Ann. § 35-15-810).

Can a Tennessee trustee use a personal account for trust money?

The statute has the trustee keep trust property separate from the trustee's own property (Tenn. Code Ann. § 35-15-810(b)) and have the trust's interest appear in a third party's records ((c)).

How long should a Tennessee trustee keep the records?

The statute states no period; the one-year rule runs from adequate disclosure or actual knowledge and the three-year fallback from the trustee's departure or the trust's end (Tenn. Code Ann. § 35-15-1005), so the record is kept at least through them.
