A binding agreement without a court
Est. & Trusts § 14.5-111 provides that, on or after October 1, 2016, the interested persons — those whose consent a court-approved settlement would require — may enter into a binding nonjudicial settlement agreement on a matter involving a trust, valid only to the extent it does not violate a material purpose of the trust and includes terms a court could properly approve. The matters it may resolve include interpreting the terms, approving a trustee's report or accounting, directing a trustee or granting a power, a trustee's resignation, appointment and compensation, transferring the principal place of administration, and a trustee's liability (§ 14.5-111(d)). Any interested person may ask the court whether the representation was adequate and whether the court could have approved the terms (§ 14.5-111(e)).
Who may represent whom
Notice to a person authorized to represent and bind another has the same effect as notice to the person represented, unless that person objects in time (Est. & Trusts § 14.5-301(a)). The holder of a qualified power of appointment may represent those whose interests are subject to it (§ 14.5-302); a guardian may represent the minor or disabled person where no conflict exists (§ 14.5-303); and a minor, an incapacitated or unborn individual, or one whose identity or location is unknown may be represented by a person with a substantially identical interest, absent a conflict (§ 14.5-304). A trustee may not serve as a representative of a beneficiary of the same trust (§ 14.5-306(b)).
The court's role, removal and remedies
A trust is not under continuing court supervision unless the court orders it, but on an interested person's invocation the court may intervene actively in the administration (Est. & Trusts § 14.5-201). The settlor, a cotrustee or a beneficiary may ask the court to remove a trustee on the grounds Est. & Trusts § 14.5-706 lists; to remedy a breach, the court may compel performance, enjoin a breach, order redress, order an accounting, appoint a special fiduciary, suspend or remove the trustee, reduce or deny compensation, or void an act, among the remedies of Est. & Trusts § 14.5-901(b).
A no-contest clause
A trust provision that penalizes an interested person for contesting the trust or instituting other proceedings is void where probable cause exists for the proceeding (Est. & Trusts § 14.5-113). Whether probable cause exists in a particular case is a question for a licensed Maryland attorney of your choosing.
