When a trust ends
A trust terminates to the extent it is revoked or expires under its terms, a court determines that no purpose remains to be achieved, or a court determines its purposes have become unlawful or impossible (R.C. 5804.10(A)). A noncharitable irrevocable trust may also end on the settlor's and all beneficiaries' consent, or on the beneficiaries' consent where continuance is not necessary to achieve a material purpose (R.C. 5804.11); because of unanticipated circumstances (R.C. 5804.12); or, where the property totals less than $100,000, on the trustee's conclusion after notice to the qualified beneficiaries that the value does not justify the cost of administration (R.C. 5804.14).
The report, the distribution and the reserve
At the termination of the trust the trustee sends the current beneficiaries, and other beneficiaries who request it, the trustee's report for the final period (R.C. 5808.13(C)). On the terminating event the trustee proceeds expeditiously to distribute the trust property to the persons entitled to it, subject to the right to retain a reasonable reserve for the payment of debts, expenses and taxes (R.C. 5808.17(B)), and may send a proposal for distribution — a beneficiary's right to object ends thirty days after it was sent where it stated the right and the time (R.C. 5808.17(A)). A release by a beneficiary is invalid to the extent induced by improper conduct or given without knowledge of the beneficiary's rights (R.C. 5808.17(C)). On termination the trustee exercises the powers appropriate to wind up the administration (R.C. 5808.16(Z)).
The optional closing process
Since 2023 a trustee may, but need not, use the process of R.C. 5801.20 to 5801.24 when concluding an irrevocable trust's administration (R.C. 5801.21). The trustee serves the terminating distributions necessary parties a dated written notice describing the terms or statute that require the distributions, the proposed distributees and assets, the forty-five-day objection period, the processes that follow, the impending bar of claims, and an exhibit of the assets and an estimate of the items still to come — with trustee's reports covering the applicable reporting period (R.C. 5801.22(B)). With no timely written objection, the trustee distributes and each person served is barred from claims against the trustee as to the matters disclosed, with the effect of a court's order settling a full account (R.C. 5801.22(C), (F)); a departing trustee may use the same process on a resignation or removal (R.C. 5801.23). Service follows R.C. 5801.24.
The periods that follow
A final report that adequately discloses a potential claim and states the time allowed starts the two-year period of R.C. 5810.05(A); otherwise the four-year period runs from the first of the trustee's departure, the end of the beneficiary's interest, the termination of the trust, or the beneficiary's knowledge of the breach (R.C. 5810.05(C)). The trust's last Ohio fiduciary income tax return is filed by its fiduciary on or before April 15 (R.C. 5747.08). Whether to use the optional process, how much to reserve and when the periods began are questions a licensed Ohio attorney of your choosing answers.

שאלות נפוצות
Must an Ohio trustee get the beneficiaries' approval to close a trust?
No statute requires it. The trustee may send a proposal for distribution that ends objections after thirty days (R.C. 5808.17(A)), or use the optional closing process whose forty-five-day objection period bars later claims (R.C. 5801.22); a beneficiary's consent or release protects the trustee only if informed (R.C. 5810.09).
How long after a trust ends can an Ohio beneficiary sue the trustee?
Two years after being sent a report that adequately discloses the potential claim and states the time allowed (R.C. 5810.05(A)); otherwise four years after the first of the trustee's departure, the end of the beneficiary's interest, the trust's termination or the beneficiary's knowledge of the breach (R.C. 5810.05(C)).
Can a small Ohio trust be ended early?
The trustee of an inter vivos trust holding less than $100,000 may terminate it, after notice to the qualified beneficiaries, on concluding that the value is insufficient to justify the cost of administration, and the court may do so on the same finding (R.C. 5804.14).
