If you are named trustee of a Pennsylvania trust, read the trust first and decide whether to serve: acceptance can come from simply acting as trustee (20 Pa.C.S. §7761). Once you serve, take control of the property (§7779), keep it separate (§7780), and send the written notice no later than 30 days after you learn of the settlor's death (§7780.3(c)).

Before you act: read, then decide
Reading the trust commits you to nothing. Find the trust instrument and every amendment and restatement, and read who is named, in what order, and how a successor takes over. A named trustee accepts by the method the trust provides or — where it provides none, or its method is not exclusive — by accepting delivery of the property, exercising powers or performing duties as trustee (20 Pa.C.S. §7761(a)); one who does not accept within a reasonable time after knowing of the designation is deemed to have rejected it (§7761(b)).
If something needs protecting before you decide — a vacant house, a perishable asset — a named trustee may act to preserve it without accepting, so long as a written rejection is sent within a reasonable time if you decline (20 Pa.C.S. §7761(c)).
The two beginnings, and what each asks of you
If the settlor is alive but can no longer manage the trust, the trust's incapacity clause governs how you take over, the trust stays revocable, and your duties are owed to the settlor (20 Pa.C.S. §7753). If a court adjudicates the settlor incapacitated, the trustee of a revocable trust sends the statute's notice to the settlor's guardian within 30 days after learning of it (20 Pa.C.S. §7780.3(b)).
If the settlor has died, the trust has become irrevocable and Pennsylvania's clocks begin from what you learn: the written notice no later than 30 days after you learn of the death (20 Pa.C.S. §7780.3(c)), and the trustee's advertisement if no estate has advertised within 90 days after the death (20 Pa.C.S. §7755(c)).
The documents to find in the first week
Most administrations need the same papers early: certified death certificates; the will, if any, and whether it has been offered for probate; deeds, account statements, brokerage and retirement statements, and insurance policies; beneficiary designations; the last income tax returns; and any record of debts. A will may be offered for probate at any time (20 Pa.C.S. §3133), and the register of wills can order a person holding a decedent's will to deposit it (20 Pa.C.S. §3137).
Assets by how they are titled
A trust holds only what was transferred to it. Sort each asset by its title: in the trust's name (yours to administer); with a named beneficiary or a payable-on-death designation (passes to that person); owned jointly with survivorship, including a home spouses held as tenants by the entireties (passes to the survivor); or in the settlor's own name (passes through the probate estate, often to the trust under a pour-over will). Pennsylvania has no transfer-on-death deed for real estate.
The beneficiaries, and what they are owed
List every beneficiary the trust names, what the trust gives each one, and their dates of birth. Pennsylvania's notices go to the "current beneficiaries" — a person 18 or older to or for whom income or principal must currently be distributed, or 25 or older to or for whom it may be distributed in the trustee's discretion (20 Pa.C.S. §7703).
A current beneficiary may ask for periodic written financial reports at least annually (20 Pa.C.S. §7780.3(i)(5)), and the trustee responds promptly to a reasonable request for information from the settlor or an irrevocable trust's beneficiary (§7780.3(a)). A beneficiary may nominate someone else to receive the notices, and the terms may let the settlor name an appointee for a beneficiary (§7780.3(k), (k.1)).
- Record each beneficiary's date of birth: the ages 18 and 25 decide who is a current beneficiary.
- Record what the trust gives each one — a mandatory interest or a discretionary one.
- Record each notice and report you send, to whom, how and when (20 Pa.C.S. §7709).

The estate, the creditors, and the reserve
After the settlor's death, a revocable trust's property answers for the settlor's creditors as the estate does, the estate's own assets applied first, and claims go through the personal representative (20 Pa.C.S. §7755). A surviving spouse may elect one-third of property that can include a revocable trust's, within six months after the death or after probate, whichever is later (20 Pa.C.S. §§2203, 2210). Hold a reserve until those periods are understood; a trustee who distributes at its own risk is protected against claims not known within 13 months after the first complete advertisement of letters, or one year after its own where no representative was appointed (20 Pa.C.S. §7755(e)).
Money, taxes, and the record from day one
Open an account in the trust's name with its own taxpayer identification number, and pay trust expenses only from it (20 Pa.C.S. §7780). Keep every receipt and record each transaction as it happens; adequate records are a duty, not a courtesy (§7780). Pennsylvania's inheritance tax return is due nine months after the death, with a five percent discount on tax paid within three months (72 P.S. §§9136, 9142).
The checklist, printable
The order below is the order most Pennsylvania administrations follow. Each line is a step the record should show, with its date:
- Read the trust and every amendment; decide in writing whether to serve (20 Pa.C.S. §7761).
- Record the date of death and the date you learned of it — the notice counts from the second (20 Pa.C.S. §7780.3(c)).
- Order death certificates; find the will, deeds, statements, designations and policies.
- Secure and insure the property (20 Pa.C.S. §7779).
- List every asset by how it is titled; note designations and joint ownership.
- Obtain the trust's EIN and open its own account (20 Pa.C.S. §7780).
- Send the written notice within 30 days of learning of the death (20 Pa.C.S. §7780.3(c), (i)).
- Learn whether an estate has advertised; if none has within 90 days of the death, advertise the trust (20 Pa.C.S. §7755(c)).
- Answer requests promptly, in writing; send financial reports when a current beneficiary asks (20 Pa.C.S. §7780.3(a), (i)(5)).
- Learn the estate's clocks: claims, the spouse's election and the inheritance tax (20 Pa.C.S. §§7755, 2210; 72 P.S. §9142).
- Hold a reserve; distribute under the trust within a reasonable time when the clocks allow (20 Pa.C.S. §7780.7).
What to avoid in the first months
Most trouble in the first months comes from a short list: mixing trust money with your own (20 Pa.C.S. §7780); selling to yourself, your family or your business (§7772); distributing before the creditor and spouse periods are understood (§7755); paying yourself without a record of the basis (§7768); and letting a beneficiary's request go unanswered (§7780.3(a)).
When a licensed Pennsylvania attorney is the right next call
TrusteeClear organizes the record and computes the possible dates from the facts you record; it does not decide whether you have accepted, who is a current beneficiary, or which notice applies. Many named trustees bring the record to a licensed Pennsylvania attorney of their choosing before declining, before a distribution, when a creditor or a spouse makes a claim, or when beneficiaries disagree.
שאלות נפוצות
Do I have to accept if I am named trustee of a Pennsylvania trust?
No. A named trustee may reject the trusteeship, and one who does not accept within a reasonable time after knowing of the designation is deemed to have rejected it (20 Pa.C.S. §7761(b)).
Can I protect trust property before deciding whether to serve?
Yes. A named trustee may act to preserve the trust property without accepting, if a written rejection is sent within a reasonable time afterward, and may inspect the property to assess liability (20 Pa.C.S. §7761(c)).
Who are the current beneficiaries of a Pennsylvania trust?
A current beneficiary is a person 18 or older to or for whom income or principal must currently be distributed, or a person 25 or older to or for whom it may be distributed in the trustee's discretion (20 Pa.C.S. §7703). Pennsylvania's notices go to them.
When can I distribute trust property in Pennsylvania?
Within a reasonable time after the event that calls for distribution, keeping a reasonable reserve (20 Pa.C.S. §7780.7). A trustee who distributes at its own risk is protected against creditors whose claims were not known within 13 months after the first complete advertisement of letters (§7755(e)).
What records should a Pennsylvania trustee keep?
Adequate records of the administration, with trust property kept separate from your own and designated as the trust's where feasible (20 Pa.C.S. §7780) — and a written record of the efforts to find any beneficiary who cannot be located (§7709).
