A signed Pennsylvania trust governs only what is transferred to it, so funding is the step that makes it work. While it is revocable you keep control and may revoke or amend it unless its terms say otherwise (20 Pa.C.S. §§7752, 7753). At your death your successor trustee sends a written notice within 30 days of learning of it (§7780.3(c)).

Funding: a trust governs what is titled to it
A Pennsylvania trust is created when a settlor with capacity signs a writing that indicates an intention to create it and contains its provisions, with a definite beneficiary and a trustee who has duties to perform (20 Pa.C.S. §7732); an oral trust is unenforceable (§7737). Signing creates the container. Funding fills it: retitling accounts and property into the trustee's name, and naming the trust where a beneficiary designation fits the plan.
Real estate is funded by a deed to the trustee. Pennsylvania has no transfer-on-death deed, so a home passes outside probate only through a funded trust or a form of joint ownership with survivorship. Anything left in your own name generally passes through your probate estate — often to the trust under a pour-over will.
While you are living: your trust, your control
A settlor may revoke or amend a trust unless its terms expressly provide that it is irrevocable (20 Pa.C.S. §7752). While the trust is revocable, the beneficiaries' rights are subject to your control and the trustee's duties are owed exclusively to you (20 Pa.C.S. §7753) — which is why, while you live and have capacity, the beneficiaries do not receive notices or reports. A revocable trust's property remains reachable by your own creditors during your life (20 Pa.C.S. §7745).
Your successor trustee
Your successor takes office by accepting — through the method your trust provides, or by taking over the property or acting as trustee (20 Pa.C.S. §7761). Tell them they are named and where the original is. Institutions will ask them for proof of authority; a certification of trust gives it without the whole instrument, stating the facts the statute lists, including the trust's taxpayer identification number (20 Pa.C.S. §7790.3).
If no named successor can serve, a vacancy is filled by a person the qualified beneficiaries appoint by unanimous written agreement, or by the court (20 Pa.C.S. §7764).
Keeping it current
Re-read the trust after any major life event. A revocable trust is amended or revoked as its terms and the statute provide (20 Pa.C.S. §7752). Divorce matters: a provision of a conveyance you could revoke at death that favors or relates to your spouse becomes ineffective if you are divorced after making it, or die domiciled in Pennsylvania during divorce proceedings after grounds are established, unless the instrument shows it was meant to survive a divorce (20 Pa.C.S. §6111.1). Beneficiary designations naming a spouse are treated the same way (§6111.2).
If you can no longer manage it
Your trust's incapacity clause says how your successor takes over while you live; the trust stays revocable, and the trustee's duties are owed to you (20 Pa.C.S. §7753). If a court adjudicates you incapacitated, the trustee sends the statute's notice to your guardian within 30 days after learning of it (§7780.3(b)). A durable power of attorney covers what the trust does not hold, and in it you may nominate the guardian a court would appoint (20 Pa.C.S. §5604).
What happens at your death
Your trust becomes irrevocable. No later than 30 days after your successor learns of your death, the successor sends a written notice to your personal representative, your spouse, your children who are sui juris and the current beneficiaries (20 Pa.C.S. §7780.3(c)). The trust's property answers for your creditors after your estate's own assets (§7755), a surviving spouse may elect a share that can reach it (§2203), and Pennsylvania's inheritance tax applies by each beneficiary's relationship to you (72 P.S. §9116).
Where to keep the original
Pennsylvania has no filing or registration for a living trust. Keep the signed original and every amendment together, safe and findable, and tell your successor where they are — a copy in an app only you can open does not meet the moment.
When a licensed Pennsylvania attorney is the right next call
TrusteeClear explains and organizes; it does not review a trust or say what is missing from it. Many people bring their plan to a licensed Pennsylvania attorney of their choosing to fund real estate, coordinate beneficiary designations, plan for the inheritance tax, or update the trust after a marriage, a divorce or a move.
Частые вопросы
Do I have to file my Pennsylvania trust anywhere after signing it?
No. Pennsylvania has no filing or registration for a living trust. The trust governs what is transferred to it, so funding — retitling property to the trustee — is the step that matters (20 Pa.C.S. §7732).
How do I fund my Pennsylvania trust?
By retitling accounts and property into the trustee's name, deeding real estate to the trustee, and naming the trust where a beneficiary designation fits the plan. Pennsylvania has no transfer-on-death deed for real estate.
Can I change my Pennsylvania trust after signing?
Yes, unless its terms expressly make it irrevocable: a settlor may revoke or amend a trust under 20 Pa.C.S. §7752, in the way the trust's terms and the statute provide.
What happens to my Pennsylvania trust if I divorce?
A revocable provision that favors or relates to your spouse becomes ineffective if you are divorced after making it, or die during divorce proceedings after grounds are established, unless the instrument shows it was meant to survive a divorce (20 Pa.C.S. §6111.1).
What does my successor trustee have to do in Pennsylvania?
Take control of and protect the trust property (20 Pa.C.S. §7779), keep it separate (§7780), send the written notice within 30 days of learning of your death (§7780.3(c)), and administer the trust in good faith under its terms (§7771).
