Pennsylvania gives each current beneficiary the right to receive, at least annually and on request, periodic written financial reports concerning the trust (20 Pa.C.S. §7780.3(i)(5)). The statute sets no list of contents, but reports sent at least annually with a conspicuous written statement start a 30-month period for objecting to what they disclose (§7785).

What Pennsylvania asks a trustee to report

Pennsylvania's duty to inform and report has three parts a trustee meets in practice: a prompt response to a reasonable request for information from the settlor or an irrevocable trust's beneficiary (20 Pa.C.S. §7780.3(a)); the written notices the statute sets after a settlor's death or adjudicated incapacity and at each change of trustee (§7780.3(b)–(g)); and periodic written financial reports concerning the trust, at least annually, on a current beneficiary's request (§7780.3(i)(5)). The whole section is one of the act's mandatory rules, which a trust's terms cannot override (20 Pa.C.S. §7705).

The statute does not prescribe a report's contents. A report that lets a beneficiary see what came in, what went out, what the trust holds and what it owes — with the trustee's own compensation shown — is the kind that does its legal work, because the 30-month period runs only from a report that disclosed the transaction (20 Pa.C.S. §7785).

Who may ask for reports

Each current beneficiary — a person 18 or older to or for whom income or principal must currently be distributed, or 25 or older to or for whom it may be distributed in the trustee's discretion (20 Pa.C.S. §7703) — has the right to the reports on request (§7780.3(i)(5)). A beneficiary may nominate another person in writing to receive the reports on the beneficiary's behalf (§7785(a)(3)), and a beneficiary may waive the notice in writing and rescind the waiver (§7780.3(j)).

The record behind the report

A Pennsylvania trustee keeps adequate records of the administration, keeps the trust's property separate from the trustee's own, and has it designated as the trust's where feasible (20 Pa.C.S. §7780). A ledger kept as transactions happen — each receipt and disbursement with its date, amount, payee and reason, and each asset with its value at the start of the period and at its end — is what turns a report into a printout. Send each report by a method reasonably suitable and likely to result in receipt, and record how and when it went (20 Pa.C.S. §7709).

The 30-month period a report can start

Pennsylvania's report-based limitation has conditions. A beneficiary is barred from challenging a transaction where the trustee sent written financial reports at least annually, the transaction was disclosed in a report (or enough was disclosed to put the beneficiary on inquiry), every report carried a conspicuous written statement of the rule, and the beneficiary did not, within 30 months after the report, notify the trustee in writing of the challenge and its basis (20 Pa.C.S. §7785(a)).

Apart from that rule, a claim by a beneficiary against a trustee is barred five years after the first of the notice of a change of trustee after a removal, resignation or death, the end of the beneficiary's interest, or the trust's termination, with the exceptions the section states (20 Pa.C.S. §7785(b)). TrusteeClear records each report, its recipients and its date; it does not say whether a report meets the statute or whether a period has run.

Settling an account without the court

On the trust's termination, the trustee's departure or intended departure, or for an interim period, a Pennsylvania trustee may settle its account without the court: it sends the persons the statute lists a notice with the reason for the settlement, the proposed distribution and estimated expenses, and account statements showing every transaction, fair market values, and realized and unrealized gains and losses for 30 months or the trust's shorter term (20 Pa.C.S. §7785.1). A recipient may object in writing within 60 days after the notice was sent; the effect of a settlement depends on the trustee's compliance with the section.

At termination: the final report and distribution

When an event terminates the trust, the trustee distributes the property within a reasonable time to the persons entitled to it, keeping a reasonable reserve for debts, expenses and taxes (20 Pa.C.S. §7780.7). A final report — sent to the beneficiaries, settled without the court under §7785.1, or filed with the orphans' court division — closes the books from the last report through the distribution date.

When an account is filed with the court

A Pennsylvania trustee files an account of the administration whenever the court directs and may file one at any other time; trustees' accounts are filed with the clerk of the orphans' court division (20 Pa.C.S. §7797). The court may also order an account as a remedy for an actual or threatened breach of trust (20 Pa.C.S. §7781).

When a licensed Pennsylvania attorney is the right next call

TrusteeClear builds the report's figures from the ledger as you go; it does not prepare the statement §7785 requires, decide whether a report qualifies, or prepare an account for the court. Many trustees bring the record to a licensed Pennsylvania attorney of their choosing before relying on the 30-month rule, before a settlement without the court, or when a beneficiary objects.

Частые вопросы

How often does a Pennsylvania trustee have to report?

Each current beneficiary has the right to receive periodic written financial reports at least annually, on request (20 Pa.C.S. §7780.3(i)(5)). A trustee who wants the 30-month rule of §7785(a) sends reports at least annually, each with a conspicuous written statement of the rule.

What must a Pennsylvania trustee's report include?

The statute sets no list of contents for the reports a current beneficiary may request (20 Pa.C.S. §7780.3(i)(5)). The 30-month period runs only from a report that disclosed the transaction, or enough to put the beneficiary on inquiry (§7785(a)).

Who is entitled to the trustee's reports in Pennsylvania?

Each current beneficiary — 18 or older with a mandatory interest, or 25 or older with a discretionary one (20 Pa.C.S. §7703) — on request (§7780.3(i)(5)); a beneficiary may nominate someone to receive the reports (§7785(a)(3)).

How long can a beneficiary challenge a Pennsylvania trustee after a report?

Where the conditions of 20 Pa.C.S. §7785(a) are met, a beneficiary who does not object in writing with the basis within 30 months after the report is barred from challenging a disclosed transaction; otherwise claims are generally barred five years after the events §7785(b) lists.

Does a Pennsylvania trust accounting have to be filed with a court?

Only when the court directs; a trustee may also file one at any other time (20 Pa.C.S. §7797). A trustee may instead settle its account without the court under §7785.1, with a 60-day period for written objections.
