When a trust ends
A trust terminates to the extent it is revoked or expires pursuant to its terms, no purpose of the trust remains to be achieved, or its purposes have become unlawful, contrary to public policy or impossible to achieve (N.J.S.A. 3B:31-26(a)). A noncharitable irrevocable trust may also end by consent — with the trustee's and all beneficiaries' consent, without court, if not inconsistent with a material purpose, or with the court's approval on the findings the section requires (N.J.S.A. 3B:31-27); the court may terminate a trust because of circumstances not anticipated by the settlor (N.J.S.A. 3B:31-28); and the trustee of a trust whose property totals less than $100,000 may terminate it, after notice to the qualified beneficiaries, on concluding that the value does not justify the cost of administration (N.J.S.A. 3B:31-30(a)).
The distribution, the reserve and the thirty-day proposal
Upon the occurrence of an event terminating or partially terminating a trust, the trustee proceeds expeditiously to distribute the trust property to the persons entitled to it, subject to the right to retain a reasonable reserve for the payment of debts, expenses and taxes (N.J.S.A. 3B:31-70(a)). The trustee may mail or deliver a proposal for distribution to all persons who have a right to object; the proposal states the right to object, that an objection must be in writing and that it must be received within 30 days after the mailing or delivery, and the right to object on the basis of the kind or value of the assets ends, if not waived earlier, when no written objection is received within those 30 days (N.J.S.A. 3B:31-70(b)). Like a report meant to start a limitation period, a proposal is a document a licensed New Jersey attorney of your choosing can prepare; interested persons may also approve a trustee's report or accounting by a nonjudicial settlement agreement (N.J.S.A. 3B:31-11(d)).
The transfer inheritance tax at the close
A bank, trust company or corporation transfers a resident decedent's stock, deposits or other assets only on the Division of Taxation's consent, after notice and with a retention, and no consent is needed for a payee in the exempt class — a spouse, civil-union or domestic partner, parent, grandparent, child or the child's issue (N.J.S.A. 54:35-19; N.J.S.A. 54:34-2). A trustee who delivers property subject to the tax on a future interest before the tax is paid is personally liable for it (N.J.S.A. 54:36-7); the tax is a lien for 15 years (N.J.S.A. 54:35-5), and interest runs from eight months after the death (N.J.S.A. 54:35-3). The Division's return, waiver and affidavit forms are the estate's and the trustee's documents; TrusteeClear names them and computes no tax.
The periods that follow
A beneficiary may not commence a proceeding against a trustee for breach of trust more than six months after being sent a report that adequately disclosed the existence of a potential claim and informed the beneficiary of the time allowed for commencing a proceeding (N.J.S.A. 3B:31-74(a)). Where that does not apply, a proceeding is commenced within five years after the first of the trustee's removal, resignation or death, the termination of the beneficiary's interest, or the termination of the trust — and never before five years after the beneficiary has attained majority, has knowledge of the existence of the trust and has knowledge of being a beneficiary (N.J.S.A. 3B:31-74(c)). The trust's final New Jersey fiduciary return is filed for the year of distribution (N.J.S.A. 54A:8-1; N.J.S.A. 54A:8-3.1). Whether to send a proposal, how much to reserve and when the periods began are questions a licensed New Jersey attorney of your choosing answers.

Поширені запитання
Must a New Jersey trustee get the beneficiaries' approval to close a trust?
No statute requires it. The trustee may send a proposal for distribution that ends a beneficiary's right to object on the basis of the kind or value of the assets after 30 days where it meets N.J.S.A. 3B:31-70(b); a beneficiary's consent, release or ratification relieves the trustee only on the conditions of N.J.S.A. 3B:31-78; and interested persons may approve a trustee's report or accounting by a nonjudicial settlement agreement (N.J.S.A. 3B:31-11(d)).
How long after a trust ends can a New Jersey beneficiary sue the trustee?
A proceeding is barred six months after the beneficiary was sent a report that adequately disclosed the existence of a potential claim and informed the beneficiary of the time allowed (N.J.S.A. 3B:31-74(a)); otherwise it is commenced within five years after the first of the trustee's removal, resignation or death, the end of the beneficiary's interest or the trust's termination, and never before five years after the beneficiary attained majority and knew of the trust and of being a beneficiary (N.J.S.A. 3B:31-74(c)).
Can a small New Jersey trust be ended early?
The trustee of a trust whose property totals less than $100,000 may terminate it, after notice to the qualified beneficiaries, on concluding that the value of the property is insufficient to justify the cost of administration, and the court may modify or terminate a trust, or remove the trustee, on the same determination (N.J.S.A. 3B:31-30(a), (b)); on such a termination the trustee distributes the property in a manner consistent with the purposes of the trust (N.J.S.A. 3B:31-30(c)).
