After signing a North Carolina will: keep the signed original safe — the clerk of superior court keeps a depository for it (N.C. Gen. Stat. § 31-11) — consider making it self-proved (N.C. Gen. Stat. § 31-11.6), and review it after a marriage, a divorce or a birth; at death it is probated before the clerk of superior court.

The signed original
An attested written will is signed by the testator and attested by at least two competent witnesses, who sign in the testator's presence though not necessarily each other's (N.C. Gen. Stat. § 31-3.3). The clerk of superior court in each county keeps a depository where a living testator may deposit the original paper will, received only from the testator or the testator's agent or attorney; it may be withdrawn on written request before the death, and is not open to inspection until then (N.C. Gen. Stat. § 31-11).
Making it self-proved
A will may be made self-proved — at signing or later — by the testator's acknowledgment and the witnesses' affidavits before an officer authorized to administer oaths, in the statute's form (N.C. Gen. Stat. § 31-11.6). The sworn statements are then accepted by the court as if taken before it.
The personal representative
The person a will names as executor serves only if qualified: not under 18, not adjudged incompetent, not a felon whose citizenship is unrestored, a nonresident only after appointing a resident process agent, and not one the clerk finds otherwise unsuitable (N.C. Gen. Stat. § 28A-4-2).
A trust under the will
A trust a will creates is administered under the North Carolina Uniform Trust Code. Its trustee accounts to the clerk of superior court only where the will directs it — or, for a will executed before January 1, 2004, unless the will provides otherwise (N.C. Gen. Stat. § 36C-2-209).
What happens at death
The will is probated before the clerk of superior court; an interested party may enter a caveat at the probate or within three years after probate in common form (N.C. Gen. Stat. § 31-32). The personal representative publishes a notice to creditors with a claim day at least three months out (N.C. Gen. Stat. § 28A-14-1) and files an inventory within three months (N.C. Gen. Stat. § 28A-20-1). A small estate may be collected by affidavit (N.C. Gen. Stat. § 28A-25-1.1).
Preguntas frecuentes
Where should I keep my North Carolina will?
Somewhere safe your personal representative can find it. The clerk of superior court in each county keeps a depository for a living testator's original paper will (N.C. Gen. Stat. § 31-11).
What does a self-proving affidavit do for a North Carolina will?
It lets the court accept the witnesses' sworn statements as if taken before it, without calling the witnesses (N.C. Gen. Stat. § 31-11.6).
How long can a North Carolina will be challenged?
An interested party may enter a caveat at the application for probate or within three years after probate in common form; a person under 18 or incompetent within three years after the disability ends (N.C. Gen. Stat. § 31-32).
