How a trust ends
A trust terminates to the extent it is revoked or expires under its terms, no purpose remains to be achieved, or its purposes have become unlawful, contrary to public policy or impossible to achieve (N.C. Gen. Stat. § 36C-4-410(a)). The settlor and all beneficiaries may compel a modification or termination without the court, even against a material purpose (N.C. Gen. Stat. § 36C-4-411(a)); the court may act for unanticipated circumstances (N.C. Gen. Stat. § 36C-4-412).
The uneconomic trust
N.C. Gen. Stat. § 36C-4-414(a) provides that, after notice to the qualified beneficiaries, the trustee of a trust whose property totals less than fifty thousand dollars ($50,000) may terminate it where the value does not justify the cost of administration, unless the instrument excludes the section by specific reference; the court may also modify or terminate a trust for that reason (N.C. Gen. Stat. § 36C-4-414(b)).
The distribution
On an event terminating or partially terminating a trust, the trustee proceeds expeditiously to distribute the trust property to the persons entitled to it, subject to a reasonable reserve for debts, expenses and taxes (N.C. Gen. Stat. § 36C-8-817) — as the beneficiaries agreed on a termination by consent, as the court ordered on one it allowed, and consistently with the purposes on one for unanticipated circumstances or an uneconomic trust (N.C. Gen. Stat. § 36C-4-418). On termination the trustee keeps the powers needed to wind up and distribute (N.C. Gen. Stat. § 36C-8-816(26)).
After the end
North Carolina has no statutory discharge-notice procedure. A beneficiary's consent, release or ratification protects the trustee where given with knowledge of the beneficiary's rights and the material facts (N.C. Gen. Stat. § 36C-10-1009), the clerk may settle a final account (N.C. Gen. Stat. § 36C-2-203(a)(3)), and no proceeding for breach of trust may be commenced more than five years after the trust's termination or the other events the statute lists (N.C. Gen. Stat. § 36C-10-1005(a)).
