Après la signature de votre trust de l'Utah

Le trust existe. Voici ce qui le fait fonctionner : le financement, la certification, votre successeur et le moment où il devient irrévocable.

A signed Utah revocable trust governs only the property transferred to its trustee (Utah Code § 75B-2-401); real property reaches it by a deed to the trustee that carries the terms or refers to a recorded instrument (§ 75B-2-816). While you are living and have capacity, the trustee's duties are owed to you alone (§ 75B-2-603); at your death your successor accepts (§ 75B-2-701), gives the 60-day notices (§ 75B-2-811(2)) and administers under the terms.

Funding: a trust governs what is titled to it

A trust is created by a transfer of property to a trustee during the settlor's lifetime, by will or another disposition taking effect at death, by an owner's declaration that the owner holds identifiable property as trustee, or by the exercise of a power of appointment (Utah Code § 75B-2-401). Signing the instrument transfers nothing by itself. Real property reaches the trust by a deed to the trustee; the terms of the trust may be given in the deed or in an instrument the grantor signs and records in the same office, and the recited terms include the trustee's name and address and the trust's name and date (§ 75B-2-816). Accounts are retitled; a policy or a retirement plan passes by its own beneficiary designation, which may or may not name the trust.

While you are living: your trust, your control

Unless the terms expressly provide that the trust is irrevocable, you may revoke or amend it (Utah Code § 75B-2-602). While the trust is revocable and you have capacity to revoke it, the rights of the beneficiaries are subject to your control and the duties of the trustee are owed exclusively to you; the trustee may follow your direction even where it is contrary to the terms (§ 75B-2-603). Property in the trust remains subject to your creditors during your lifetime (§ 75B-2-505).

Your successor trustee

Name a successor, and an alternate, in the instrument: a vacancy is filled first by the person the terms designate, then by a person the qualified beneficiaries unanimously agree on, then by the court (Utah Code § 75B-2-704). On the death of a sole trustee the trust estate vests immediately in the successor on the successor's appointment and qualification (§ 75B-1-103). The successor accepts by the trust's method or by acting as trustee (§ 75B-2-701), needs no court order (§ 75B-2-201), and shows a bank a certification of trust rather than the instrument (§ 75B-2-1013). Tell the successor where the original is.

Keeping it current

A revocable trust is revoked or amended by substantial compliance with a method its terms provide or, where the terms provide no method or the method is not expressly exclusive, by a later will or codicil that expressly refers to the trust or specifically devises its property, or by any other method manifesting clear and convincing evidence of your intent (Utah Code § 75B-2-602). Where more than one settlor created or funded the trust, each may revoke or amend the portion attributable to that settlor's contribution. Review the instrument after a marriage, a divorce, a birth, a death, a move or a sale, and after a change in the law — the Code was recodified into Title 75B on May 7, 2025, and a citation to the former chapter in your instrument remains a valid citation to the renumbered section (§ 75B-1-102).

If you can no longer manage it

A revocable trust can name the successor to serve when you cannot, by the terms' own test of incapacity. An agent under a power of attorney may exercise your powers over the trust only to the extent the trust's terms or the power expressly authorize it; a conservator or guardian may do so only with the supervising court's approval (Utah Code § 75B-2-602). Beside the trust, an advance health care directive — a health care instruction and a power of attorney for health care — covers decisions the trust cannot (§ 75A-9-106, § 75A-9-107); without one, a default surrogate decides in the statute's order of priority (§ 75A-9-111).

What happens at your death

The trust becomes irrevocable. Within 60 days after acquiring knowledge of that, your successor notifies the qualified beneficiaries of the trust's existence, your identity as settlor, the right to request a copy of the instrument and the right to a trustee's report (Utah Code § 75B-2-811(2)(c)), and within 60 days after accepting, of the acceptance and the trustee's contact details (§ 75B-2-811(2)(b)). The trustee may give the trust's own notice to creditors (§ 75B-2-508); the trust property answers for your creditors' claims, the costs of administering your estate and your family's allowances to the extent the probate estate is inadequate (§ 75B-2-505); and a contest of the trust is commenced within the earlier of three years after the death and 90 days after the trustee sends the instrument and the notice (§ 75B-2-604). Then the trustee distributes under the terms, with a reasonable reserve (§ 75B-2-815).

Where to keep the original

Keep the signed original where the successor can find it and tell the successor where that is; keep a copy with your attorney if you have one. A certification of trust (Utah Code § 75B-2-1013) serves most institutions, so the original rarely leaves its place. If the trust holds real property, keep the recorded deed with it (§ 75B-2-816).

When a licensed Utah attorney is the right next call

Whether an asset is funded, whether an amendment was made in the way the terms require, how an incapacity clause is triggered, and whether a power of attorney reaches the trust are questions for a licensed Utah attorney of your choosing. TrusteeClear explains the statutes and organizes the record; it reviews nothing you prepare.

Questions fréquentes

Is my Utah trust funded just because I signed it?

No. A trust governs the property transferred to its trustee (Utah Code § 75B-2-401); real property reaches it by a deed to the trustee (§ 75B-2-816), accounts by retitling, and policies and plans by their own beneficiary designations.

Can I change my Utah revocable trust?

Yes, unless the terms expressly provide that it is irrevocable: by substantial compliance with the terms' method or, where none is exclusive, by a later will or codicil that expressly refers to the trust or by any other method showing clear and convincing evidence of your intent (Utah Code § 75B-2-602).

Does my successor trustee need a court order when I die?

No. The administration proceeds without any court's order or approval unless an interested party invokes the court (Utah Code § 75B-2-201); the successor accepts by the trust's method or by acting as trustee (§ 75B-2-701) and shows a certification of trust (§ 75B-2-1013).

Can my agent under a power of attorney change my Utah trust?

Only to the extent the trust's terms or the power of attorney expressly authorize it; a conservator or guardian may exercise your powers only with the supervising court's approval (Utah Code § 75B-2-602).
