A Maryland trustee keeps adequate records (Est. & Trusts § 14.5-810) and, on a qualified beneficiary's request, sends a report annually and at termination — property, liabilities, receipts, disbursements, the trustee's compensation and the assets with their values (§ 14.5-813(c)). A report that adequately discloses a potential claim and states the time allowed starts one year to sue (§ 14.5-904).

The records come first
A trustee keeps adequate records of the administration, keeps the trust property separate from the trustee's own, and has it titled so the trust's interest appears in records kept by someone other than the trustee or a beneficiary where feasible; the property of separate trusts may be invested together only where the records show each trust's interest (Est. & Trusts § 14.5-810). Every receipt, every payment and the document behind it belongs in the ledger from the first day.
The report a qualified beneficiary may request
On request by a qualified beneficiary, the trustee sends that beneficiary, annually and at the termination of the trust, a report of the trust property, liabilities, receipts and disbursements, including the source and amount of the trustee's compensation, a listing of the trust assets and, if feasible, their respective market values (Est. & Trusts § 14.5-813(c)(1)). Maryland sets no report without a request — but the duty to report on request, and to respond promptly to a request for information, cannot be removed by the trust's terms (Est. & Trusts § 14.5-105(10)).
On a vacancy in the trusteeship, unless a cotrustee remains, the former trustee sends a report to the qualified beneficiaries who request it, and a personal representative, guardian or attorney-in-fact may send it on the former trustee's behalf (§ 14.5-813(c)(2), (3)).
Principal and income
Maryland's principal and income rules (Est. & Trusts §§ 15-501 … 15-530) decide whether a receipt or a disbursement belongs to income or to principal where the trust's terms do not — a separate question from how the trust's income is taxed. Before converting a trust to a unitrust, reconverting it, or adjusting between principal and income, the trustee mails the qualified beneficiaries, and the trust's creator if living, a notice of the proposed decision that allows at least 30 days after the mailing for written consents; the trustee proceeds on every qualified beneficiary's written consent, and otherwise the trustee or a qualified beneficiary may petition the circuit court to review the decision (Est. & Trusts § 15-502.3).

| You are named trustee and do not want the office | A designee who does not accept within a reasonable time after knowing of the designation is deemed to have rejected it. | A designee who has not accepted may reject; without accepting, a designee may act to preserve the trust property if a rejection is sent within a reasonable time to the settlor or, where the settlor is dead or lacks capacity, to a qualified beneficiary, and may inspect the property. | — | Est. & Trusts § 14.5-701(b), (c) ↗ |
| You accept | At once and throughout; no day-count. | Administer the trust reasonably under the circumstances, in accordance with its terms and purposes and the interests of the beneficiaries; solely in the beneficiaries' interests (§ 14.5-802(a)) and impartially among them (§ 14.5-803). | — | Est. & Trusts § 14.5-801 ↗ |
| You accept | At once; no day-count. | Take reasonable steps to take control of and protect the trust property (a revocable trust's tangible property not in the trustee's possession excepted); keep adequate records, keep the property separate and have it titled to show the trust's interest where feasible. | — | Est. & Trusts §§ 14.5-809, 14.5-810 ↗ |
| You accept, or the trust receives assets | No day-count; the standard applies to every decision. | Administer as a prudent person would, considering the trust's purposes, terms, distributional requirements and other circumstances, with reasonable care, skill and caution. The prudent investor rule of Est. & Trusts § 15-114 binds a trust company, an investment adviser it controls and a fiduciary who elects into it. | — | Est. & Trusts § 14.5-804 ↗ |
| You accept the trusteeship | Within 60 days after accepting. | Notify the qualified beneficiaries of the acceptance and of the trustee's name, address and telephone number — not owed by a trustee who accepted before January 1, 2015, or for a trust irrevocable before that date (§ 14.5-813(e)). | The qualified beneficiaries — each beneficiary who, on the date of determination, is a distributee or permissible distributee of trust income or principal, or would be one if those interests ended on that date or the trust terminated on that date (Est. & Trusts § 14.5-103(u)) — and any beneficiary who has sent the trustee a request for notice (§ 14.5-110(a)). | Est. & Trusts § 14.5-813(b)(1)(i) ↗ |

The information duty and the report on request are not confined to that date. | — | Est. & Trusts § 14.5-813(e) ↗ |
| The trust's terms waive or change the notices | Not as to a qualified beneficiary of an irrevocable trust who has attained 25 years of age. | The terms prevail over most of the Act, but not over the duty to notify the qualified beneficiaries of an irrevocable trust who have attained 25 of the trust's existence, the trustee's identity and their right to request reports and a copy of the trust, or to respond to their requests for reports and information. | — | Est. & Trusts § 14.5-105(11) ↗ |

The report that starts the one-year limitation
Except as the release procedure provides, a beneficiary may not bring a judicial action against a trustee for breach of trust more than one year after the beneficiary or a representative is sent a report that adequately discloses the existence of a potential claim and informs of the time allowed for bringing an action (Est. & Trusts § 14.5-904(a)). A report adequately discloses a potential claim if it gives enough information that the beneficiary knows of the claim or should have inquired into it (§ 14.5-904(b)); the section does not limit the time for a breach committed in bad faith or with reckless indifference (§ 14.5-904(c)).
Whether a particular report starts that year is a question of its contents — a document a licensed Maryland attorney prepares. TrusteeClear's report organizes your ledger; it never says a report started a period.
The optional release procedure at the end
On a termination, or on a trustee's resignation or removal, the trustee may send each interested party, by first-class and certified mail, return receipt requested, a report that states the termination, resignation or removal; gives an accounting of the trust, such as account statements, for the immediately preceding five years, an estimate of the property still expected, and the fees still owed; and states that the party may object in writing within 120 days, that a party who does not is deemed to have released the trustee and ratified the trustee's actions, and that the trustee knows of no undisclosed information that could give rise to a claim (Est. & Trusts § 14.5-907(c), (d)). A release induced by improper conduct, or given without knowledge of the beneficiary's rights or the material facts, does not protect the trustee (§ 14.5-907(b)).
The court-supervised lane
A trust is not subject to continuing court supervision unless a court orders it (Est. & Trusts § 14.5-201(b)). Where a circuit court has assumed jurisdiction over a fiduciary estate, the Maryland Rules call for an inventory within 60 days, an annual account within 60 days after the accounting year and a petition to terminate within 45 days after grounds are discovered (Md. Rules 10-706, 10-707, 10-710) — that lane's own rules and forms, outside TrusteeClear's plan.
When a licensed Maryland attorney is the right next call
Whether a report should be drafted to start the one-year limitation, whether to use the release procedure, how a receipt is allocated between principal and income, and whether a unitrust conversion or an adjustment is available are questions a licensed Maryland attorney of your choosing answers. TrusteeClear keeps the ledger and the receipts, organizes the report's contents from them, and decides none of them.

Does a Maryland trustee have to send an annual accounting?
On a qualified beneficiary's request, yes — a report annually and at the termination of the trust, with the property, liabilities, receipts, disbursements, the trustee's compensation and the assets with their values (Est. & Trusts § 14.5-813(c)(1)). Without a request, the statute sets no annual report, though the trustee keeps adequate records throughout (§ 14.5-810).
How long does a Maryland beneficiary have to sue a trustee?
One year after being sent a report that adequately discloses a potential claim and states the time allowed (Est. & Trusts § 14.5-904(a)) — with no such limit for a breach in bad faith or with reckless indifference (§ 14.5-904(c)). Other periods of limitation apply where no such report was sent.
Can a Maryland beneficiary waive the trustee's report?
Yes — and withdraw the waiver as to future reports (Est. & Trusts § 14.5-813(d)). The trust's terms cannot remove the duty itself (§ 14.5-105(10)).
What is the 120-day release procedure?
An optional procedure on a termination, resignation or removal: a report with five years' accounting and the statute's statements, sent by first-class and certified mail; an interested party who does not object in writing within 120 days is deemed to have released the trustee (Est. & Trusts § 14.5-907(c)–(e)).
