Pennsylvania's duty to inform and report, explained

Pennsylvania wrote its own version of the uniform duty to inform and report. This guide walks through 20 Pa.C.S. §7780.3 — who is told what, and when — and the report-based limitation period it connects to.

Answering requests

20 Pa.C.S. §7780.3(a) provides that a trustee responds promptly to a reasonable request for information about the trust's administration from the settlor or from a beneficiary of an irrevocable trust, and to the Department of Human Services' certified request in the cases the statute states. The whole section is one of the act's mandatory rules, which a trust's terms cannot override (§7705).

The notices, counted from what the trustee learns

Each notice runs from the day the trustee learns of an event, not from the event itself. No later than 30 days after learning of it, the trustee of a revocable trust notifies the settlor's guardian of an adjudication of incapacity (20 Pa.C.S. §7780.3(b)) and, after the settlor's death, the personal representative, the spouse, each child who is sui juris and the current beneficiaries (§7780.3(c)). The trustee of an irrevocable trust notifies the current beneficiaries after the settlor's adjudicated incapacity or death, and notifies a current beneficiary not yet told (§7780.3(d)–(f)).

Each change of trustee is notified in writing — to the settlor and, where the settlor has died or the trust is irrevocable with an adjudicated settlor, to the current beneficiaries — with the trustee's name, address and telephone number; the statute states no period (§7780.3(g)). A beneficiary may waive the notice in writing and rescind the waiver (§7780.3(j)); a settlor's appointee or a beneficiary's nominee may receive notices for a beneficiary on the conditions the statute states (§7780.3(k), (k.1)).

Financial reports and the 30-month rule

Each current beneficiary has the right to receive, at least annually, upon request, periodic written financial reports concerning the trust (20 Pa.C.S. §7780.3(i)(5)). Where the trustee sends reports at least annually, each carrying a conspicuous written statement of the rule, a beneficiary who does not notify the trustee in writing of a challenge to a disclosed transaction, with its basis, within 30 months after the report is barred from challenging it (§7785(a)); other claims are generally barred five years after the events §7785(b) lists.

How notices are sent

A notice is sent by a method reasonably suitable and likely to result in receipt — first-class mail, personal delivery, delivery to the last known residence or place of business, or a properly directed electronic message (20 Pa.C.S. §7709). A person whose identity or location is unknown and not reasonably ascertainable need not be notified, but the trustee keeps a written record of the efforts to find the person.

Questions fréquentes

When does the Pennsylvania trustee's notice period start?

From the day the trustee learns of the event — the settlor's death, an adjudication of incapacity, or a current beneficiary not yet notified — not from the event itself (20 Pa.C.S. §7780.3(b)–(f)).

Can a Pennsylvania trust waive the duty to inform?

The trust's terms cannot override §7780.3, one of the act's mandatory rules (20 Pa.C.S. §7705). A beneficiary may waive the notice in writing and later rescind the waiver (§7780.3(j)).

What starts the 30-month period in Pennsylvania?

A written financial report that disclosed the transaction, sent as one of reports at least annually, each with a conspicuous written statement of the rule (20 Pa.C.S. §7785(a)).
